Terms of Service

These terms are an agreement between you and Otodate (“Otodate”, “we”, “us”). By creating an account or using Otodate, you agree to them. If you use Otodate for a business, you agree on behalf of that business and confirm you’re allowed to.

1. The service

Otodate lets repair shops (“you”) post updates about the vehicles they work on, and lets the vehicles’ owners follow those updates. We may change, add or remove features at any time.

2. Your account

You must give accurate information and be at least 18. You’re responsible for everything done under your account, including by your staff and by any device signed in with your shop’s QR code and PIN. Keep your password and PIN safe, and tell us right away if you think someone used your account without permission.

3. Your content and your customers

You own what you put into Otodate: vehicles, notes, photos and your customers’ details (“your content”). You give us permission to store, process and show your content only as needed to run and improve the service.

You are responsible for your content and for having your customers’ consent, or another lawful basis, to record their details and photos and share updates with them. You decide what is recorded; we handle it on your behalf.

4. Acceptable use

Don’t use Otodate to break the law, to harm or harass anyone, to send spam, to upload content you have no right to, or to try to access data that isn’t yours. Don’t copy, resell, reverse engineer or disrupt the service. We may remove content or suspend accounts that break these rules.

5. Plans and payment

Your first vehicles are free; after that, Otodate is a paid subscription. Subscriptions renew automatically each month until cancelled, and you can cancel anytime; cancelling stops future charges at the end of the current period. Fees are not refundable except where the law requires. Prices may change with advance notice, and taxes may apply. Payments are processed by our payment provider.

6. Your work with your customers

Otodate is a communication tool. You alone are responsible for the repair work, prices, estimates, agreements and decisions between you and your customers. We are not a party to them. Records in Otodate (including recorded answers) are only as accurate as what you and your team enter.

7. No warranty

Otodate is provided “as is” and “as available”. We work to keep it running and secure, but we don’t promise it will always be available, error-free or fit for a particular purpose. Keep your own records of anything important.

8. Limitation of liability

To the fullest extent the law allows, Otodate will not be liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or US$100 if that is more.

9. Indemnity

You agree to defend and hold Otodate harmless from claims, damages and costs arising from your content, your use of the service, your dealings with your customers, or your breach of these terms.

10. Ending your account

You can close your shop anytime in Settings; this deletes your data and stops your subscription. We may suspend or end accounts that break these terms or that we must close by law. Sections 3, 6, 7, 8 and 9 continue after your account ends.

11. Changes

We may update these terms. If a change is significant, we’ll let you know in the app or by email before it takes effect. Using Otodate after that means you accept the new terms.

12. General

These terms are governed by the laws of the place where Otodate’s operator is established, without regard to conflict-of-law rules. If any part is found unenforceable, the rest still applies. Not enforcing a right is not a waiver of it. These terms and our Privacy Policy are the whole agreement between us about Otodate.
